Ex-manager jailed six years over death of maid's baby


SHAH ALAM (27.10.2016): A 43-year-old man has been sentenced to six years in jail for causing the death of a six-month-old baby boy.

On Thursday, High Court judge Justice Datuk Wan Afrah Wan Ibrahim meted out the sentence on Wong Weng Yew, a former cleaning services company manager, and ordered him to serve the jail sentence from the date of his arrest on June 3, 2014.

He was charged with causing the death of Esmen Zeus Yves on May 28, 2014, between 8pm and 11pm at a house in Kota Kemuning near here.

Wong, who was wearing a grey T-shirt and dark jeans, kept his head bowed when the charges were read out again in court.

He was charged under Section 304(b) of the Penal Code for culpable homicide not amounting to murder, which carries a jail term of up to 10 years, or a fine, or both.

He also faced another charge under Section 201 of the Penal Code for disposing of the boy’s body into the ravine.

During mitigation, Wong’s counsel Datuk Geethan Ram Vincent re­­ques­­ted for a lighter sentence, saying that his client had been cooperative throughout the investigation, and had led the police to the place where the body was disposed. 

DPP Siti Balkiah Abd Yazaid asked for deterrent punishment by taking into account public interest and the severity of the offence after a life was lost.

“A deterrent pu­nishment should be delivered to prevent anyone from taking matters into their own hands,” she said.

Justice Wan Afrah then sentenced Wong to six years in jail for the first offence followed by three years in jail for the second offence and instructed the jail terms to run concurrently from his date of arrest.

An Indonesian maid, who was working with Wong for two years gave birth to Esmen on Nov 21, 2013, after having a relationship with a foreign man.

The baby was placed under his care at his house, which was also occupied by his wife and several other foreign workers, while the baby’s mother lived elsewhere.

On May 31, 2014, the Indonesian woman reported that her son went missing. 

Police later found Esmen’s decomposed remains in a ravine in Genting Highlands, with his body wrapped in a plastic bag and kept in a luggage bag.

Wong was initially charged under Section 302 of the Penal Code, which carries the mandatory death sentence upon conviction. 

However, it was later changed to one with a lower punishment.

It is learnt that Wong’s 36-year-old wife, who was initially arrested with him, was released on a court bond and became a prosecution witness. 

Wong has one child and five stepchildren.
